Terms of Service

1. Introduction and Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you and Brazhelp Solutions(trading as "Construforce") ("Construforce", "we", "us", or "our"), governing your access to and use of the Construforce platform, website, and mobile application (collectively, the "Platform"). By registering an account, subscribing to any tier, or otherwise accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Platform. These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Description of the Platform
Construforce is a two-sided digital marketplace connecting construction trade workers ("Workers") with construction companies, contractors, and recruitment agencies ("Companies") operating primarily in the United Kingdom. The Platform enables Workers to create professional profiles, manage availability, and receive job offers, while Companies can search for available trade professionals, post job opportunities, and manage their workforce pipeline.
Construforce acts solely as an intermediary technology platform. We do not employ Workers, guarantee employment outcomes, or act as a recruitment agency. All contractual arrangements for work are made directly between Workers and Companies.
3. Eligibility
To use the Platform you must: (a) be at least 18 years of age; (b) have the legal right to work in the United Kingdom or be a company lawfully incorporated and operating in the UK; (c) provide accurate, current, and complete information during registration; and (d) maintain the security of your account credentials. By using the Platform you represent and warrant that you meet all eligibility requirements.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or used in violation of these Terms.
You may not create more than one account per individual or company without our prior written consent. Accounts are non-transferable.
5. Subscription Plans and Billing
The Platform operates on a subscription model. The current pricing tiers are set out below. All prices are inclusive of VAT where applicable and are charged in Pounds Sterling (GBP).

Subscriptions are billed monthly on a recurring basis via Stripe, our third-party payment processor. By subscribing, you authorise Construforce to charge your payment method on a recurring monthly basis until you cancel. You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial months unless required by applicable law.
We reserve the right to modify pricing with 30 days' written notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
6. Worker Obligations
Workers using the Platform agree to: (a) provide accurate information regarding their qualifications, certifications (including CSCS cards), and work history; (b) maintain their availability status accurately and update it promptly when circumstances change; (c) hold all licences, certifications, and right-to-work documentation required by UK law for the trades they advertise; (d) not misrepresent their skills, experience, or identity; and (e) comply with all applicable health and safety legislation when engaged on any construction site.
Construforce does not verify the authenticity of all documents uploaded to the Platform. Workers are solely responsible for the accuracy of their profile information. Providing false information may result in immediate account suspension and may constitute a criminal offence under the Fraud Act 2006.
7. Company Obligations
Companies using the Platform agree to: (a) be a legitimately incorporated or registered business entity; (b) use Worker data solely for the purpose of assessing suitability for genuine employment or contract opportunities; (c) comply with all applicable employment law, including the Equality Act 2010, the Working Time Regulations 1998, and the National Minimum Wage Act 1998; (d) not share Worker profile data, documents, or contact information with third parties without the Worker's explicit consent; and (e) only request document access (CSCS cards, NI numbers) after a genuine offer has been made and accepted.
8. Prohibited Conduct
You must not use the Platform to: (a) post false, misleading, or fraudulent job offers or profiles; (b) harass, discriminate against, or abuse other users; (c) scrape, copy, or redistribute Platform data without our written consent; (d) circumvent or attempt to circumvent any security or access controls; (e) use automated tools, bots, or scripts to access the Platform; (f) engage in any activity that violates applicable UK or EU law; or (g) solicit Workers or Companies to transact outside the Platform in order to avoid subscription fees.
9. Intellectual Property
All content, design, software, trademarks, and intellectual property on the Platform are owned by or licensed to Brazhelp Solutions. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for its intended purpose. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
By uploading content to the Platform (including profile information, documents, and messages), you grant Construforce a non-exclusive, royalty-free licence to store, process, and display that content solely for the purpose of operating the Platform.
10. Document Access and Confidentiality
Sensitive Worker documents (including CSCS cards and National Insurance numbers) are stored securely and are only accessible to a Company after the following conditions are met: (a) the Company has sent a direct job offer; (b) the Worker has accepted the offer; and (c) the Worker has explicitly authorised document access. Companies receiving document access must treat all such information as strictly confidential and must not retain copies beyond the period necessary for the specific engagement.
11. Disclaimers and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Construforce disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, Construforce's total liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the total subscription fees paid by you in the three months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
12. Termination
You may terminate your account at any time by contacting us at [email protected] or through your account settings. We may suspend or terminate your account immediately if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law.
Upon termination, your right to access the Platform ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable law.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
